A legal opinion states that municipal councillors are the employers of municipal staff and "certain District human resources policies" might not be applicable to them.
In response to a human resources complaint from Maple Ridge Councillor Corisa Bell, the District of Maple Ridge sought a legal opinion from Young Anderson to clarify the status of councillors.
"An individual cannot act as part of the governing body and be an employee at the same time given the conflict of interest that would result," the lawyer Carolyn MacEarchern wrote in her legal opinion. This is why a municipal employee must take a leave of absence if running for office and resign if elected, she added.
